1. Introduction
These Terms of Service ("Terms") form a legally binding agreement between you and Divine Feminine Ventures Inc (“Divine”), the operator of Lummra (the "App" or "Services"), a social media platform for sharing content among users aged 16 and older. By accessing or using the Services, you agree to these Terms, Divine’s Privacy Policy, and Divine’s Community Guidelines. If you do not agree, do not use the Services. Divine may update these Terms at any time; continued use constitutes acceptance of changes.
2. Eligibility and Age Requirements
You must be at least 16 years old to use the Services. By creating an account, you represent and warrant that: (a) you meet this age requirement; (b) you are fully able and legally competent to agree to these Terms; and (c) if you are under age 18, you have obtained the consent of your parent or legal guardian to use the Services. If you are under 18, please be sure your parent or legal guardian has reviewed and discussed these Terms with you. Divine do not knowingly allow accounts for anyone under 16. If Divine discovers an underage user, Divine will terminate the account and delete associated data in accordance with applicable laws like COPPA and GDPR. You must not be prohibited from using the Services under applicable laws (e.g., on sanctions lists).
3. User Content
"User Content" means any text, images, videos, audio, comments, or other materials you upload, post, or transmit via the Services. You retain ownership of your User Content but grant Divine a worldwide, royalty-free, non-exclusive, perpetual, irrevocable, sublicensable, and transferable license to host, store, use, display, reproduce, modify, adapt, distribute, create derivative works from, and promote your User Content for operating, promoting, improving, and researching the Services (including in aggregated or anonymized forms). This license allows Divine to make your content available to other users and third parties as reasonable or necessary. You are responsible for your User Content and must ensure it complies with these Terms and all applicable laws. You waive any moral rights and agree to indemnify Divine and its officers for any claims arising from your content.
For public User Content (e.g., posts visible to non-friends), you grant Divine an unrestricted license for broader use, including syndication and promotion, without compensation.
4. Prohibited Actions and Conduct
You agree not to:
- Post, upload, or share illegal, harmful, abusive, harassing, defamatory, obscene, hateful, discriminatory, or threatening content (including anything promoting violence, self-harm, or bullying).

5. Content Moderation
Divine uses a combination of AI tools and human moderators to review User Content for compliance with these Terms, Community Guidelines, and applicable laws. Divine may automatically scan, flag, or remove content that violates policies, appears harmful, or risks Divine’s community (e.g., via keyword detection, image analysis, or user reports). Human reviewers handle appeals and edge cases. Divine does not guarantee all content is reviewed, and you should not rely on the Services for confidential or sensitive information. You can report violations in-app. Divine may disclose content to authorities if required by law. Removed content may be permanently deleted, and Divine is not liable for its loss.
6. Termination and Suspension
You may stop using the Services at any time by deleting your account via in-app settings. Divine may suspend or terminate your access immediately, without notice, for violations of these Terms, legal requirements, or to protect users/Services. Upon termination, your license to use the Services ends, but sections 3, 7, 8, 9, and 10 survive. Divine will notify you where reasonably feasible and provide appeal options for suspensions.
7. Intellectual Property
Divine owns all rights to the App, including software, logos, and features (excluding User Content). You are granted a limited, revocable, non-exclusive license for personal, non-commercial use. You may not copy, modify, or reverse-engineer the Services. Divine respects IP rights and will remove infringing content upon valid notice under laws like the DMCA. 8. Disclaimers and Limitation of Liability
The Services are provided "AS IS" without warranties of any kind, express or implied, including express or implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by law, Divine is not liable for indirect, incidental, special, or consequential damages, including loss of data or profits. You agree that Divine’s (including its officers’) total liability is limited to the lesser of $100 or the total amount paid by you to Divine in the prior 12 months.
9. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of laws principles. For EU users, Divine complies with mandatory local laws.
You agree that any and all legal or equitable claims or disputes, of whatever form, arising out of or in connection with these Terms and Conditions, your use of the site or app, or your relationship with Divine will be settled by binding arbitration with the American Arbitration Association. This agreement applies to the all allegations, disputes, claims for relief, and alleged violations including but not limited to those based on federal, state or local statute, ordinance or governmental regulation or rule, tortious conduct, contract, regardless of whether the statute, ordinance, regulation, rule, or common law doctrine was recognized at the time this agreement was signed. To the maximum extent allowed by applicable law, the costs and expenses of the arbitration shall be borne evenly by the parties. Where absolutely required by law, Divine will bear the costs and expenses of the arbitration.
YOU AND DIVINE HEREBY WAIVE ANY RIGHT EITHER MAY HAVE TO A TRIAL BY JURY IN ANY MATTER DESCRIBED IN THIS SECTION. YOU AND DIVINE MAKE THIS WAIVER KNOWINGLY, INTENTIONALLY AND VOLUNTARILY, AND EACH ACKNOWLEDGES THAT NO REPRESENTATIVE, AGENT OR ATTORNEY OF EITHER PARTY HAS MADE ANY REPRESENTATIONS OF FACT TO INDUCE THIS WAIVER OF TRIAL BY JURY OR IN ANY WAY TO NULLIFY OR MODIFY ITS EFFECT. YOU ACKNOWLEDGE THAT YOU HAD THE OPPORTUNITY TO BE REPRESENTED IN THE MAKING OF THIS WAIVER BY INDEPENDENT LEGAL COUNSEL AND THAT YOU HAVE READ AND UNDERSTANDS THE MEANING AND RAMIFICATIONS OF THIS WAIVER PROVISION.
10. General
These Terms and Conditions, together with the Community Guidelines and the Privacy Policy are the entire agreement between you and Divine. Divine may assign rights without your consent.
